Discussion –
“The powers delegated by the proposed Constitution to the federal government are few and defined.” So said James Madison. Education is not one of the few defined powers delegated to the Federal Government by the Constitution.
The Department of Education is yet another example of the Federal Government taxing people in order to give money back to the States. If the States choose to further education, they are perfectly capable of doing so themselves.
One small exception is funding for Indian education. This is a responsibility of the Federal Government and should be transferred to the appropriate Department. Also, the 14th Amendment requires equal protection under the law, which includes education wherever located. However, that is a matter for the Department of Justice.
